General Terms and Conditions for Consignment Sales
Applicable from 12/01/2023
These general conditions define the rules and practices governing the relationship between the owner of a product as specified in article 2 and the consignment store Blue-Cherry, located at 230B Route de Berne, 1066 Épalinges.
They encompass all commitments of both parties. By accepting these general terms of sale, the product owner is deemed to accept them unconditionally. Blue-Cherry, on its part, commits to acting as an intermediary while adhering to these conditions.
Article 1: Deposit and Depositor: Any adult may deposit their products, as specified in article 2, of which they are the owner, at Blue-Cherry, Route de Berne 230B, 1066 Épalinges.
Article 2: Accepted Products: Clothing from newborn to 14 years old, in excellent condition, corresponding to the current season, is accepted. Blue-Cherry reserves the right to refuse certain articles or sizes based on its inventory.
Article 3: Deposit Procedure: Deposits can be made via the online Blue-Cherry account or at the showroom, by appointment. Identification is required for the initial deposit.
Article 4: Quality Charter: At Blue-Cherry, we value and practice total transparency and honesty, therefore we expect the same from sellers. Please only bring items to Blue-Cherry that are in perfect condition (previously checked, cleaned and correctly folded.
All garments received are submitted to a rigorous quality control.
To guarantee the best look, comfort and quality to our customers, we only accept:
- Premium quality brands (see list below).
- Sizes range: from 0 to 14 years old.
- Only garments that are in perfect condition, with :
- No stains, holes, pilling, and without signs of extensive use (graying, stretching, etc.).
- Clothes have been properly cleaned and folded before deposit.
- Clothes have the brand label and size visible (Cut composition labels are accepted).
- The child's name should not be visible on the clothes, or if present, please take necessary action to hide it (cutting, crossing out, etc.).
Blue-Cherry reserves the right to refuse items that do not conform (do not correspond to the quality and appearance agreed with the seller) and do not meet customer or seasonal expectations. Articles rejected during quality control will be notified to the depositor via email or SMS. They must be retrieved by the depositor within 10 days after quality control. If not collected within this period, Blue-Cherry will donate them to partner charitable organizations and/or recycling companies. These can be collected by the depositor directly from our showroom or returned by post if the seller pays the postage costs.

Article 5: Sales Price: The sales price can be set by Blue-Cherry or by the depositor. Three options are provided for determining the sales price.
Blue-Cherry reserves the right to adjust the sales price, upwards or downwards, if deemed inappropriate. The depositor will be notified and will have 48 hours to accept or reject this modification.
Article 6: Commission Rate: Different commission rates apply depending on the chosen deposit option, ranging from 40% to 30% of the gross sales price in-store.
- Commission 40-60: For depositors who utilize their Blue-Cherry account to register items before depositing them, they'll receive a 40% reimbursement of the total selling price, inclusive of taxes, in the store. (For instance, if an item sells for CHF10 in the store, the depositor will receive CHF4. The 7.7% VAT remitted to tax authorities will be deducted from Blue-Cherry's earned commission, with the remaining funds allocated towards operational expenses).
- Commission 70-30: Items not registered through Blue-Cherry prior to deposit will receive a 30% reimbursement of the total selling price, inclusive of taxes, in the store. (For instance, if an item sells for CHF10 in the store, the depositor will receive CHF3. The 7.7% VAT remitted to tax authorities will be deducted from Blue-Cherry's earned commission, with the remaining funds allocated towards operational expenses).
Article 7: Contract Duration: The sales mandate is exclusive for a period of one year. The depositor agrees not to withdraw the items deposited during this period.
Blue-Cherry requests that depositors collect their unsold items within 30 days after the end of their contract.
Any unclaimed unsold items at the end of this period will be donated to charitable associations or recycling companies.
If Blue-Cherry deems that an unsold item, within the contract period, still fits the store's inventory, it may be retained on deposit for an extended duration.
Article 8: Payment to depositor: Sale proceeds are credited to the depositor's fund for future purchases. The depositor may request a monthly bank transfer to retrieve their balance.
Article 9: Dispute: Blue-Cherry acts as an intermediary and cannot be held responsible for malicious acts by the depositor.
Article 10: Insurance: Blue-Cherry takes out insurance covering civil liability, theft, and fire for the items deposited within its premises, up to the amount reimbursed by said insurance company.
